1. Parties and Property

This Short-Term Vacation Rental Agreement (“Agreement”) is between IDC Properties FL LLC (“Owner”) and the primary guest named on the reservation (“Guest”) for the direct booking of Sundays on Putnam, a vacation rental property in Sarasota, Florida (“Property”).

2. Reservation and Occupancy

The reservation is valid only for the dates, number of guests, and approved pets listed in the booking confirmation. The primary Guest must be at least 25 years old and must occupy the Property throughout the stay. Maximum occupancy is six guests. Only registered guests may stay at or use the Property.

3. Check-In and Check-Out

Check-in begins at 3:00 p.m. and check-out is by 11:00 a.m., unless Owner approves different times in writing. Early arrival or late departure is not permitted without advance approval.

4. Rental Payments

A payment equal to 25% of the reservation total is due at booking. The remaining 75% is due 30 days before arrival. If a reservation is made fewer than 30 days before arrival, the full reservation amount is due at booking. The $250 refundable security deposit is separate from the rental charges; its collection or authorization method and timing must be disclosed at checkout. A reservation is confirmed only after the required initial payment is processed and Owner accepts the booking.

5. Cancellation and Refunds

  • Cancellations received 30 or more days before arrival receive a full refund of rental charges and applicable refundable fees.
  • Cancellations received 14–29 days before arrival receive a refund equal to 50% of rental charges, plus applicable refundable fees.
  • Cancellations received fewer than 14 days before arrival receive no rental-charge refund, except as required by law or expressly agreed by Owner.

Guest must submit cancellation in writing. The cancellation period is measured from the scheduled 3:00 p.m. Eastern Time check-in. If Guest has paid only the 25% initial payment when cancelling in a period that permits Owner to retain more than that payment, whether any additional amount is due must be expressly disclosed and agreed before booking; this draft does not establish an additional collection right. The security deposit is refundable if Guest cancels before occupying the Property and no lawful deduction applies. Cleaning fees for services not performed and pet fees for pets that did not occupy the Property will be refunded. Applicable taxes and other charges will be handled according to law and the disclosed booking terms. Guest is encouraged to purchase travel insurance. Nonwaivable legal rights remain unaffected.

6. Refundable Security Deposit

A $250 refundable security deposit is required. The deposit may be applied to documented damage beyond ordinary wear and tear, missing or damaged items, pet-related damage, and actual reasonable extraordinary cleaning or other losses caused by a breach of this Agreement, to the extent permitted by law. Owner will provide an itemized explanation of deductions. Any remaining refundable balance will be returned or released within 14 days after check-out, subject to applicable law, mandatory deposit-handling requirements, and payment-processing timelines. Ordinary wear and tear will not be charged. The deposit does not limit Guest’s responsibility for other amounts lawfully owed.

7. Pet Policy

Pets are permitted only with advance approval. A nonrefundable fee of $150 per approved pet, per stay applies. Pets must stay off all furniture and beds. Pets left unattended inside the home must be safely secured in a crate and may not roam freely while guests are away. Pets must be supervised outdoors, including in the fenced yard. Guest must promptly remove pet waste and is responsible for actual pet-related damage and extraordinary cleaning to the extent permitted by law. An unapproved ordinary pet is a material violation of this Agreement. Legally protected service animals will be accommodated as required by applicable law without prohibited pet fees or restrictions.

8. Pool and Outdoor Areas

The pool and outdoor areas are used at Guest’s own risk. No lifeguard is provided. Children and non-swimmers must be supervised by a responsible adult at all times. Running, diving, glass containers, and unsafe conduct are prohibited in and around the pool. Guest must follow all posted pool and safety instructions and keep access doors and gates secured. Pool heating is complimentary upon advance request; a particular water temperature is not guaranteed because conditions vary. Pool and patio use is subject to the 10:00 p.m.–7:00 a.m. quiet hours in Section 9. Quiet hours do not establish a separate mandatory pool closing time.

9. Quiet Hours

Quiet hours are 10:00 p.m. to 7:00 a.m. Guests must avoid excessive noise or other conduct that disturbs neighbors at all times.

10. Parties, Events, and Visitors

No parties or events are permitted. Registered guests only may be on the Property unless Owner gives advance written approval.

11. Smoking and Vaping

Smoking and vaping are prohibited everywhere on the Property. Guest is responsible for remediation, deodorizing, cleaning, or damage resulting from a violation.

12. Parking and Electric-Vehicle Charging

A maximum of two vehicles may be parked in the designated gravel driveway. Street, lawn, or unauthorized parking is prohibited. The universal Tesla-compatible EV charger may be used in accordance with the posted operating instructions. Guest is responsible for safe and proper use.

13. Property Care

Guest will keep the Property and its contents in good condition, use appliances and furnishings only as intended, and promptly report damage or unsafe conditions. Furniture, linens, equipment, and household items may not be removed from the Property.

14. Trash and Recycling

Guest will place trash and recycling in the designated bins and follow the instructions provided at the Property. Collection is Monday morning; bins must be placed at the designated curb location Sunday night when the stay includes that collection period.

15. Maintenance and Owner Access

Guest will promptly notify Owner of maintenance concerns. Owner or an authorized representative may enter the Property when reasonably necessary to protect the Property, perform repairs, respond to an emergency, or address a reported concern, with notice when circumstances permit.

16. Emergencies

For an immediate emergency, Guest must call 911 first and then notify Owner. Guest must follow evacuation orders and safety directions from public authorities. The Property is located in Evacuation Zone C.

17. Personal Property and Liability

Guest is responsible for personal belongings and for the conduct and safety of all members of the reservation party and approved visitors. Owner is not responsible for loss, theft, damage, injury, weather, utility interruption, or circumstances beyond Owner’s reasonable control, except as required by law.

18. Violations and Termination

A material violation of this Agreement, occupancy limits, safety rules, or applicable law may result in notice to correct the violation and lawful termination of the stay or other remedies available under applicable law. Owner will not use unlawful self-help removal or lockout. Any refund and responsibility for documented costs will be determined under applicable law and the circumstances.

19. Reservation Changes

Changes to dates, occupancy, guests, pets, or other reservation details require Owner’s written approval and may result in revised rates, fees, taxes, or payment deadlines.

20. Governing Law and Entire Agreement

This Agreement is governed by the laws of the State of Florida. The booking confirmation, this Agreement, and any written reservation-specific terms accepted by Owner and Guest constitute the entire agreement for the stay. If a provision is unenforceable, the remaining provisions remain in effect.

21. Acceptance of Agreement

Guest accepts this Agreement by completing the direct-booking checkout process and affirmatively agreeing to its terms. Guest confirms that the reservation information is accurate, that Guest has reviewed these terms, and that Guest agrees to be responsible for all occupants, approved visitors, and approved pets associated with the reservation.
